I hate engineers. They like to design things so the common man can't work on 'em, and takes a profesional a whole lotta hours (and thus his fee) to fix it, when a twenty cent item and four minutes of work should do the trick.

Chip's guy is a building inspector with a structural engineer on staff that will prepare a report for me. That's what I need to take to the lawyer.

Here's the problem with that. You will most likely go to mediation. At that point if the builder feels like he is losing he will probably offer to fix the problem with labor and materials instead of a cash settlement. Your lawyer, working on a contigency will resist this. The mediator could tell you to go fuck yourself because you aren't willing to negotiate.
Ask CharlotteDude how this suing the builder shit works.

You just described why we howled directly to Ryland's VP's instead of suing them when we were pissed and having problems. It's a LOT more trouble than it was worth. Or to us it was anyway.

The developer here is the president of the NC homebuilder's Association. He's also one of 4 developers. He's the smart one. He won't lie to you, but he never quite tells the truth. One guy flat out lied to at least 5 of us concerning the way these walls are put together. As of Nov 16, we'll know what we're looking at when the engineer comes out and drills holes in my wall through to the neighbor's. After that, with signed affadavits saying we were lied to plus the fact that they aren't meeting code (none of the electrical outlets are caulked properly to meet the firewall code as I understand it) a lawyer, a structural engineer, and 18 homeowners ready to sue....I think they'll be willing to settle before the matter goes to court. Phase 2 is constructed differently. That's admission of a problem there.

The engineer was here this morning and stated that the existing construction does NOT meet industry standard for sound insulation. He will have to doublecheck to make sure the firecode is not correct. We should have a written report to take to the lawyer along with estimates from Jody Cook within 1-2 weeks.
The construction is 2x4 studs, blown cellulose insulation, and one sheet of 5/8" drywall on one side and one sheet of 1/2" drywall on the opposite side of the party wall. The outlets are not caulked for fire ratings either. Nor is the drywall in the attic "stamped" for fire ratings.
We will know more once he has reviewed the 1999 code and sends me the report.

Trace, in party wall construction where a 1 hour firewall is required, the outlets should be caulked with a fire rated caulking to insure that a fire on one side of the wall cannot jump to the other unit within an hour.
